WHAT IS SPEEDING, VTL § 1180

Speeding, VTL § 1180 is when a motorist travels either (1) in excess of the posted speed limit, or (2) under the posted speed limit but unreasonably fast for the conditions; or (3) traveling too slow for conditions. Yes, you can get charged with driving too slow, and that is considered a speeding conviction. A common example for traveling unreasonably fast for conditions is when a motorist lost control of a car and ran off the road. Speeding in a work zone or school zone are aggravated charges causing fines to be doubled and bigger problems with your insurance company.

HOW A SPEEDING CONVICTION CAN LEAD TO A SUSPENSION OR REVOCATION OF YOUR DRIVER’S LICENSE

Whether or not your license is in New York, your license or privileges can be suspended for a speeding conviction. The ways are as follows:

  • You can be suspended as part of a sentence
  • You can be suspended for a conviction triggering 11 or more points with other points within an 18 month period
  • You can be revoked for accruing 3 speeding convictions in an 18 month period
  • When a NY license or privileges are suspended or revoked the result is the same – you cannot drive until the suspension or revocation is cleared. So the best practice is to avoid the suspension or revocation altogether.

VARIOUS DEGREES OF SPEEDING AUO

There are varying degrees of Speeding, VTL § 1180:
Speeding 1 – 10 MPH over the limit: 3 point violation
Traveling unreasonably fast: 3 point violation
Traveling unreasonably slow: 3 point violation
Speeding 11 – 20 MPH over the limit: 4 point violation
Speeding 21 – 30 MPH over the limit: 6 point violation& mandatory DMV fine 
in addition to the court fine of at least $300.00.
Speeding 31 – 40 MPH over the limit: 8 point violation& mandatory DMV fine in addition to the court fine of at least $450.00.
Speeding 41 + MPH over the limit: 11 point violation& mandatory DMV fine in addition to the court fine of at least $600.00, plus a mandatory license suspension
