VTL § 1120 – Driving on the Right Side of the Road
NY VTL § 1120 proscribes that all motorists must drive on the right side of a roadway, except in the following situations:
- When passing another vehicle traveling in the same direction
- When passing a cyclist, pedestrian, animals, or obstructions in the roadway
- When road obstructions require that a person drive left, so long as you yield to opposing traffic
- When it is permissible to travel in the shoulder or slope pursuant to NY VTL § 1131
- On a one way street
- Upon a roadway divided into 3 marked lanes
- Notwithstanding, when a vehicle is traveling less than the normal speed of traffic, they must drive on the right. Further, on a roadway laned for four or more lanes of two way moving traffic, it is prohibited to drive left of center except when authorized to do so by the lane markings, or to avoid or pass a pedestrian, cyclist, animal, or road hazard.

There are numerous defenses to a charge of NY VTL § 1120. You are permitted to drive left when passing a motorist, pedestrian, animal, or road hazard. It is also permissible to drive left on a one way street, or when a roadway is divided into 3 marked lanes, such as interstates. Often, VTL § 1120 is charged with other similar violations.
